Terms of service

1. Who we are and purpose

These terms govern the use of Psynthia (https://psynthia.app), a service of [RAZÓN SOCIAL DEL TITULAR DE PSYNTHIA], with tax ID (NIF) [NIF] and registered address at [DOMICILIO SOCIAL] (“Psynthia”, “we”). You can contact us at hola@psynthia.app.

Psynthia is a software tool for psychology professionals: patient and practice management, session recording and transcription, artificial intelligence assistance, reports, scheduling, bookings and patient payments. By creating an account you accept these terms and the privacy policy (/legal/privacy).

2. For professionals only

Psynthia is offered exclusively to professionals and businesses that use it in the course of their professional activity, not to consumers. By registering you declare that you are acting for professional purposes, that you are of legal age and that you (or the members of your practice) are qualified to carry out the activity for which you use the service.

For that reason, consumer and user protection rules (such as the right of withdrawal) do not apply unless a mandatory rule provides otherwise.

3. Account and practice

You are responsible for the accuracy of your account data, for safeguarding your credentials and for whatever is done from your account. We recommend enabling two-step verification; the practice may require it of all its members.

Whoever creates the practice is its owner: they invite members, assign roles and are answerable for the use those members make of the service within the practice. Notify us without delay if you detect unauthorised access.

4. Plans, trial and prices

Psynthia offers a free plan, with no time limit, and paid plans (Professional, Team and Enterprise) with different features, numbers of members and artificial intelligence credits. The current features and prices of each plan are published on the pricing page and in the application.

You can try the Professional plan free for 14 days, without a card. When the trial ends, if you do not take out a paid plan, the account reverts to the free plan without losing your data.

All prices are expressed in euros and do not include VAT or other applicable taxes, which will be added to the invoice.

5. Artificial intelligence credits

AI features (transcription, reports, assistant and Word add-in) consume credits. Each paid plan includes a number of credits per period and you can buy additional top-ups, which do not expire while the account is active. You can check consumption by feature in the application. Credits cannot be exchanged for money.

6. Payments and billing

Payments are processed through Stripe. Subscriptions are charged in advance at the start of each period (monthly or annual) and renew automatically until you cancel them.

If a charge cannot be made, we may restrict paid features until the situation is regularised. We may change prices by giving you at least 30 days' notice; the new price will apply from the next renewal and you may cancel beforehand if you do not agree.

On the free plan, payments your patients make through Psynthia carry a fee of 3% of the amount, in addition to Stripe's fees. Paid plans do not carry that fee.

7. Plan changes, cancellation and account closure

You can change plan or cancel the subscription at any time from Settings. Cancellation takes effect at the end of the period already paid for, until which you keep the plan's features; no refunds or pro-rata adjustments are made for the current period.

You can close your account from Settings. To close it, the practice must have no other members or pending invitations. Closure permanently deletes the account and all the practice's data, including patient data and their files, and cancels the subscription. Before closing it, download whatever you need to keep: Psynthia lets you export a ZIP per patient. Invoices are retained for the period required by law.

We may suspend or close an account that seriously breaches these terms, giving prior notice unless urgency or the law prevents it, and giving you the opportunity to export your data where possible.

8. Acceptable use

You undertake not to:

  • Use Psynthia for unlawful purposes or process people's data without the necessary legal basis.
  • Record sessions without the patient's informed consent.
  • Attempt to access other practices' data, or circumvent the security measures, plan limits or credit system.
  • Overload the service, reverse engineer it or resell the service without our permission.

9. Artificial intelligence and clinical responsibility

AI-generated transcripts, summaries, notes, reports and answers are an aid for the professional and may contain errors or omissions. They are not a diagnosis and do not replace clinical judgement.

The professional reviews and is solely responsible for the clinical content they keep, sign or deliver, for the decisions they make and for their relationship with their patients. Psynthia does not provide health care services.

10. Session recording and consent

Before recording a session, the professional must inform the patient and obtain their consent. Psynthia offers tools to collect and record it, but the obligation to obtain it lies with the professional.

11. Data protection

With respect to their patients' data, the professional or practice is the controller and Psynthia the processor. That processing is governed by the data processing agreement (art. 28 GDPR) published at /legal/dpa, which forms part of these terms and prevails over them in data protection matters. Sub-processors are listed at /legal/subprocessors. The processing of your account data is described in the privacy policy.

12. Your content and our intellectual property

The data and content you upload or generate in Psynthia belong to you (or to your patients). We only use them to provide the service to you, in accordance with the data processing agreement; we do not use them to train AI models.

The software, the brand and the other elements of Psynthia belong to us or to our licensors. We grant you a non-exclusive, non-transferable right of use while your account is active.

13. Service availability

We work to keep Psynthia continuously available, but we do not guarantee that it will operate without interruptions or errors: there may be downtime for maintenance, provider incidents or causes beyond our control. The status of the service is published on its status page. We do not currently make our own scheduled backups, so we recommend that you regularly export the data you need to keep.

We may improve or modify the features of the service. If we withdraw an essential feature from a paid plan, we will give you reasonable advance notice.

14. Liability

To the extent permitted by law, our total liability to you for any claim related to the service is limited to the amount you have paid us in the 12 months preceding the event giving rise to it, and we are not liable for indirect damages or loss of profits. These limitations do not apply in cases of wilful misconduct or gross negligence, nor to obligations that the law does not allow to be limited.

15. Changes to these terms

We may amend these terms. If the change is material, we will notify you by email or in the application at least 30 days in advance; if you do not agree you may cancel before it takes effect. Continuing to use the service afterwards implies acceptance of the new terms.

16. Governing law and jurisdiction

These terms are governed by Spanish law. For any dispute, the parties submit to the courts and tribunals of [FUERO], unless a mandatory rule provides otherwise.

The Spanish version prevails; translations into other languages are provided as a courtesy.
